A New Jersey court is considering allowing the contents of a driver's onboard computer to be used as evidence in a death by auto case. The onboard computer records several seconds up to several minutes of speed, braking action, recent vehicle activity, steering wheel positions, etc. If allowed, it would be the first time this information is allowed in a NJ trial.
Prosecutor Matthew Murphy told Judge Robert Reed told that information from event data recorders of each vehicle provides data such as their speeds and throttle positions. He plans to call an expert in interpreting the data to the stand during Locane’s as-yet unscheduled trial.
The defendant's counsel argues that the information is untested and unreliable.
